1. E-Commerce & Privacy
The Website www.vernoncresswell.co.za presents Vernon Cresswell as Speaker. The use of any product bought from this Website is at the purchaser’s risk. The purchaser/ user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained during a shark trip sold on the Website.
The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product.
The Provider undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold. The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.
The Provider will supply all goods to the delivery company in good order. The Provider will not be held liable for the condition of goods arriving at the User’s chosen delivery address.
Cancellation fee if cancelled by the User
- 30 days or more before the time of start date
- 7 days before or less than 30 days before start date – 50% of the fee
- 48 hours before the start date – 100% of the fee
The Provider reserves the right to cancel a trio for which payment has already been received. This may occur if due to bad weather. Should the Provider exercise this right, the User will receive a full refund with no deductions.

2. CANCELLATION & RETURNS
You have the right to cancel your order within 5 working days after the day on which the order was placed, provided such order is cancelled in writing and despatched to Vernon Cresswell by faxing your cancellation request to +27 (0)11 706 0378 or e-mailing vernon@vernoncresswell.co.za
- In the event that the ordered goods have already been dispatched on the date of receipt of your cancellation request, you must return the goods to us within 30 days of the dispatch of the cancellation request. Within 30 days of receipt of the goods by ourselves and if the goods are found to be in order, we will refund you the purchase price paid for the goods less any reasonable delivery costs incurred in the dispatch of the goods.
- If you do not return the goods within 30 days of your receipt thereof, you will be deemed to have accepted the goods and will be liable for the purchase price thereof.
- Should the goods be demonstrated to be defective, you are required to contact us in writing within 5 days of receipt of your order.
- Cancelled and/or returned orders are subject to the delivery charges payable by yourself. However, if the goods are proved to be defective in any respect, you will not charge you the delivery charges.
3. REFUNDS
Vernon Cresswell will pay over the refund to the credit card used at the time of purchase upon receiving the returned goods. Please allow 30 days for the refund to appear on your credit card statement. If you have made payment by any other means we will send you a cheque or will transfer the refund via Electronic Funds Transfer.
4. DOMICILIUM
Vernon Cresswell chooses as its domicilium citandi et executandi for all purposes under the website, including in the giving of any notice, the payment of any sum, the serving of any process, as follows:
